Bank of America, N.A., Successor by Merger with BAC Home Loans Servicing, L.P., fka Countywide Home Loans Servicing, L.P., Plaintiff vs. Samuel J. Smith, Jr., et al., Defendants.

Defendants, Samuel J. Smith, Jr., whose last known address is 4280 Tallmadge Road, Rootstown, Ohio 44272 and John Doe and/or Jane Doe, Real Names Unknown, the Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of Samuel J. Smith, Jr., Deceased, whose Identities and Addresses are Unknown, will take notice that on December 6, 2011, Bank of America, N.A., Successor by Merger with BAC Home Loans Servicing, L.P., fka Countywide Home Loans Servicing, L.P., filed its Complaint against them and others in the Common Pleas Court of Summit County, Ohio, being Case No. 2011 CV 01195, alleging that the Defendants, Samuel J. Smith, Jr., and John Doe and/or Jane Doe, Real Names Unknown, the Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of Samuel J. Smith, Jr., Deceased, have or claim to have an interest in the real estate described below.

Premises commonly known as: 4280 & V/L Tallmadge Road, Rootstown, Ohio 44272.

Permanent Parcel Numbers: 32-022-30-00-006-000 and 32-022-30-00-007-000.

The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute.

The Plaintiff demands that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.

Said above named Defendants will further take notice that they are required to answer the Complaint on or before the 1st day of February, 2012.
