In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, May 7, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 21, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

 

The following real property:

Situated in the Township of Paris, County of Portage and State of Ohio:

And being part of Lot 13 in said township, and also known as being part of that parcel conveyed to Robert E. Neiss as recorded in Vol. 1150, Page 774, and being more fully bounded and described as follows:

Beginning for the same, at a bridge spike found in the center line of Holcomb Road (C.H. 187-B) 60 feet R/W, at its intersection with the South line of Lot 13 (witness a 1/2 inch iron bar found N. 89 deg. 25 min. 15 sec. W., 1903.19 feet at the Southwesterly corner of Lot 13); thence N. 00 deg. 13 min. 59 sec. E., 1754.43 feet along said center line, to a bridge spike found at the Southwesterly corner of a parcel conveyed to R.T. & C.S. Beck (1005/106); thence N. 89 deg. 28 min. 04 sec. E., 1987.23 feet (passing over a 5/8 inch rebar w/cap set at 30.00 feet), along the South line of said Beck parcel, to a 6 inch concrete monument with a brass disk found in the Easterly line of Lot 13; thence S. 00 deg. 52 min. 47 sec. E., 1792.46 feet, along the East line of said Lot 13, to a 5/8 inch rebar w/cap set at the Southeasterly corner thereof; thence N. 89 deg. 25 min. 15 sec. W., 2021.90 feet along the South line of said lot, to the place of beginning and containing 81.578 acres of land, more or less, as determined by a survey made by Stephen P. Campbell, Professional Surveyor No. 7330, in March 1997. (C&A Project No. 97471). The bearings used to prepare this description are based on an assumed meridian and are used to indicate angles only.

Said Premises Located at 9988 Holcomb Rd., Newton Falls, OH 44444.

Said Premises Appraised at $425,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
