In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 20, 2020, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 4, 2020 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Mantua to-wit:

 

And known as part of Original Mantua Township Lot No. 18 and is further described as follows:

Beginning at a marked stone found at the Northwest corner of said Lot 18; thence along the Westerly line of said Lot 18, S. 00 deg. 50 min. 10 sec. East, a distance of 208 feet to an iron rod set and the true place of beginning for this parcel of land; thence North 88 deg. 59 min. 38 sec. East, a distance of 2213.24 feet to a point in the centerline of Sheldon Road TH 273, 66 feet wide and passing over an iron rod set at a distance of 33.03 feet from said point; thence along the centerline of Sheldon Road S. 01 deg. 28 min. 38 sec. West, a distance of 206 feet to a point; thence S. 88 deg. 59 min. 38 sec. West, a distance of 2204.92 feet to an iron rod set in the Westerly line of said Lot 18 and passing over an iron rod set a distance of 33.03 feet; thence along the Westerly line of said Lot 18 N. 00 deg. 50 min. 10 sec. West, a distance of 205.81 feet to the true place of beginning and containing a total of 10.4372 acres of land as surveyed and described in October 1995 by Don Trocchio, Registered Surveyor No. 6445, be the same more or less.

Being the same property conveyed to Kenneth Falzini Jr. and Melissa D. Falzini, husband and wife, for their joint lives, remainder to the survivor of them by deed from Michael C. Kohler and Sharon V. Kohler, husband and wife, recorded 12/12/2014 in 201418904, in the recorder's office of Portage County, Ohio.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 12279 Sheldon Rd., Mantua, OH 44255.

Said Premises Appraised at $235,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
