By virtue of an Order of Sale Portage County Case No. 2019 TF 00001 to me directed from the Court of Common Pleas, of Summit County, Ohio, I, STEVE M. BARRY, Sheriff of said County, will offer for sale at Public Venue, at the West door of the Court House, in Akron, on the 22nd day of November, 2019 at 10:00 o'clock A. M. of said day, the following described Lands and Tenements, to-wit:

Situated in the City of Stow, County of Summit and Portage and State of Ohio:

And being part of Lot 80, Stow City, and further known as being the Northerly portion of that certain tract of land containing 25.41 acres which was conveyed to F. J. Jerome a predecessor in title of the Grantor herein, by deed dated from Robert C. and Maud E. Mellin, bearing date of May 21, 1909 and recorded in Volume 376, Page 468 of deed of records of Summit County and by deed from Lorin J. Mellin, bearing date May 21, 1909 and recorded in Volume 363, Page 421 of the Summit County Deed Records, said land herein conveyed being more particularly described as follows:

Beginning at the Northwesterly corner of land conveyed by the deed aforesaid said corner being indicated by the letter "A" on Plat No. 22843 attached to and made a part of the said deed from Robert C. and Maud E. Melling, said plat being recorded in Plat Book 11, Page 26, Summit County Records of Plats; thence Easterly along the Northerly line of the land conveyed by the deed as aforesaid a distance of 681.4 feet, more or less to the Northeasterly corner of land so conveyed, said corner being indicated by the letter "B" on the said recorded plat; thence Southerly along the Easterly line of the land conveyed by the deeds as aforesaid and being along the line between Summit County and Portage County, a distance of 1535.01 feet more or less, to the Northeasterly corner of that certain tract of land containing 2.82 acres which was conveyed by F. J. Jerome and Lucy F. D. Jerome to the Lake Erie and Pittsburgh Railway Company at the 29th parcel in deed bearing date of April 3, 1911 and recorded in Volume 393, Page 567 of deed records of Summit County, said corner being at a point distant 75 feet by rectangular measurement Northerly from the centerline of the railroad of the Lake Erie and Pittsburgh Railway Company; thence Westerly along the Northerly line of the land conveyed to the Lake Erie and Pittsburgh Railway Company as aforesaid, a distance of 701.9 feet, more or less, to the Northwesterly corner of the land so conveyed said corner being at a point in the Westerly line of land conveyed to F. J. Jerome by the deed as aforesaid distant 100 feet by rectangular measurement Northerly from the said centerline of railroad; thence Northerly along the Westerly line of conveyed to said F. J. Jerome by the deeds as aforesaid a distance of 1357.5 feet more or less, to the place of beginning and containing 22.58 acres of land, be the same more or less, but subject to all legal highways, as surveyed by R. E. Stockman, RS 5134, together with the right to perpetually use, for ingress and egress that portion of land, designated on previous filed survey plats as a portion of Shawnee Drive, fifty (50) foot wide, located between Lots 1 and 2.

The Grantee, her successors and assigns shall have a four fourteenths interest in a 50 foot private drive known as Shawnee Drive, known as being part of Franklin Township Lots 64 and 81 and further described as follows:

Beginning at a point in the West line of Lot 64 and Portage County, N. 4 degrees 12' 29" E., 1497.71 feet as measured along said West line fro the Southwest corner of Lot 64; thence continuing N. 4 degrees 12' 29" E., 947.02 feet along said West line; thence S. 64 degrees 16' 10" E., 704.46 feet; thence S. 85 degrees 31' E., 1358.84 feet; thence N. 4 degrees 29' E., crossing the North line of Lot 64 at 476.03 feet, 695.83 feet; thence N. 37 degrees 32' E., 187.74 feet; thence N. 59 degrees 23' W., 621.85 feet; thence N. 30 degrees 37 E., 250.00 feet along the Easterly line and extension thereof of Lot No. 38 in the Judson Road Allotment, as recorded in Plat Book 23, Page 57, of the Portage County Records of Plats, to the Northeast corner of said lot; thence S. 59 degrees 23' E., 50.00 feet along the South line of Judson Road, T.H. 143, to the Northwest corner of Lot No. 39 in said allotment; thence S. 30 degrees 37' W., 200.00 feet to the Southwest corner of Lot No. 39; thence S. 59 degrees 23' E., 576.45 feet along the South line of said allotment; thence S. 51 degrees 28 E., 51.45 feet to the Southwest corner of Lot No. 45 in said allotment; thence S. 37 degrees 32 W., 223.10 feet; thence S. 4 degrees 29' W., crossing the North line of Lot 64 at 204.95 feet, 731.00 feet to the North line of H. and R. Green; thence N. 85 degrees 31' W., 1408.84 feet along the North line of Green F. and P. Fisher, C. and L. Wingers, H. and I. Verset and H. and G. Bentley to Bentley's Northwest corner; thence N. 64 degrees 16' 10" W., 635.87 feet to a point of curve; thence 19.46 feet along the arc of a curve to the left having a central angle of 111 degrees 31' 21", a radius of 10.00 feet and a chord of 16.53 feet bearing S. 59 degrees 58' 10" W. to a point of tangency; thence S. 4 degrees 12' 29" W., 812.52 feet; thence S. 85 degrees 47' 31" E., 632.69 feet to the West line of Bentley; thence S. 1 degree 32' W., 347.79 feet to Bentley's Southwest corner; thence S. 85 degrees 22' 45" E., 373.38 feet to an iron pin at an angle point in the center line of Spell Road, T.H. 42; thence S. 43 degrees 40' 25" W., 67.54 feet along said center line; thence S. 70 degrees 19' 31" W., 1959 feet; thence N. 85 degrees 22' 45" W., 359.78 feet along a North line of S. and C. Hegedus; thence N. 1 degree 32' E., 357.97 feet; thence N. 85 degrees 47' 31" W., 634.97 feet to the beginning and containing 7.013 acres of land, be the same more or less, as surveyed by R. E. Stockman, RS 5134.

TERMS OF SALE: $10,000.00 deposit in cash, certified check or bank check payable to the Sheriff of Summit County, Ohio, to be tendered at sale at the time of acceptance of the bid. The purchaser shall be required to pay interest at the rate of ten percent (10%) on the unpaid balance of the bid amount, unless paid within eight (8) days after the date of sale. The entire balance of the purchase price shall be paid within 30 days after the filing of the Confirmation Entry.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20, at 10:00 a.m. and at the same place on the 6th day of December, 2019. The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B))
