In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, October 21, 2019, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, November 4, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

Being the North 24 feet of Lot No. 11 and the South 36 feet of Lot No. 12 in Babcock and Motz Allotment of part of Original Lots Nos. 8 and 9 of the South Division of Lots in said Township, as per plat of said allotment recorded in Volume 4, Page 25 of records of plats of Portage County, Ohio; being a tract of land having a frontage of 60 feet on the West side of Lot No. 8 and extending Easterly from said Westerly line of uniform width 200 feet.

Beginning at an iron pipe on the East line of said Lot 44 at the Northeast corner of land formerly owned by William T. Morgan, said place of beginning being 233 feet N. 2 deg. 40' East from a stone at the Southeast corner of said lot; thence North 76 deg. 29' West along Morgan's North line 169.78 feet to the centerline of Wall Street and passing over an iron pipe at 20.18 feet at the side of the street; thence North 21 deg. 18' East, along the centerline of Wall Street 60.5 feet to the South West corner of land formerly owned by Fred W. Gauding; thence South 75 deg. 43' East along Gaudings South line 150.49 feet to an iron pipe on the East line of said Lot 44, which iron pipe is 1 foot South of the North West corner of an iron pipe which is 36 feet North of the Southwest corner of Lot No. 12 in the Babcock and Motz Allotment and passing over an iron pipe at 20.15 feet at side of Wall Street; thence South 2 deg. 40' West along the lot line 59 feet to the place of beginning and containing 0.216 acres of land.

Being a part of Lot No. 44 of South Division of Lots in said Township and being a parcel of land lying on the side of the centerline of the records of Portage County and recorded in Book 22, Page 29 of records of Portage County and being located within the following described points in the boundary commencing at a point at the Northeast corner of said township Lot No. 44; thence South 02 deg. 49' 00" West, along the centerline survey and existing right of way of Wall Street, a distance of 1,441.92 feet to a point; thence 22 deg. 15' 25" West along said centerline survey and existing right of way, a distance of 434.37 feet to a point at the owner's Northwest property corner, said point being at Station 2, plus 41.83 centerline survey and existing right of way of Wall Street and the true place of beginning for the parcel herein conveyed; thence South 74 deg. 45' 35" East, along the Owner's Northerly property line, a distance of 25.19 feet to a point on the proposed Easterly right of way line of Wall Street; thence South 22 deg. 15' 25" West, along said proposed Easterly right of way line, a distance of 59.89 feet to a point on the owner's Southerly (property line; thence North a distance of 25.27 feet to a point at this owner's Southwest property corner; thence North 22 deg. 15' 25" East, along the centerline survey and existing right of way of Wall Street and this owner's Westerly property line a distance of 60.50 feet to the place of beginning and containing 1.505 square feet, more or less, including the present road which occupies 1,205 square feet, more or less, right of ingress and egress to and from any residual areas particularly Wall Street (County Highway 159-A) are retained. Description for the above parcel is based on a survey made by Thomas F. Moore, Registered Surveyor No. 4718.

 

The sheriff's office nor any affiliate have access to the inside of said property.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
